Welcome to Mina Grocery. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from Mina Grocery (“Mina,” “we,” “us,” or “our”). By visiting our website, placing an order, or purchasing products from us, you agree to these Terms.

1. About Mina Grocery

Mina Grocery is an independent specialty grocery retailer located in Omaha, Nebraska. We offer a curated selection of grocery items, specialty foods, refrigerated and perishable products, beverages, gifts, and other goods.

Our website is powered by Shopify, which provides the ecommerce platform that allows us to offer products and services online.

2. Product Availability

Many of our products are specialty, seasonal, perishable, imported, small-batch, or available in limited quantities. Product availability may change quickly.

Adding an item to your cart does not reserve that item. We reserve the right to limit quantities, discontinue products, correct inventory discrepancies, or cancel an item that becomes unavailable.

If an item in your order is unavailable, we may contact you regarding a substitution, remove the unavailable item and refund its price, or cancel the affected portion of your order.

3. Product Information, Images & Variations

We make reasonable efforts to accurately describe and photograph our products. However, packaging, labeling, color, size, appearance, ingredients, country of origin, recipes, and other product characteristics may occasionally change without notice from the manufacturer or producer.

Images are provided for reference and may not depict the exact packaging or appearance of the product you receive.

For products sold by weight, the final weight may vary slightly from the estimated or listed weight. Where applicable, pricing may be adjusted based on the actual weight of the item.

4. Food Allergies & Dietary Information

Product descriptions, ingredient information, dietary designations, and allergen information are provided for convenience and may be based on information supplied by manufacturers or producers.

Customers with food allergies, intolerances, sensitivities, or specific dietary requirements are responsible for reviewing the product's current packaging and ingredient information before consumption.

Mina Grocery does not guarantee that any product has been prepared, packaged, stored, or handled in an environment completely free from particular allergens unless expressly stated by the product manufacturer.

If you have a serious food allergy, please contact us before purchasing if you have questions about a product.

5. Perishable & Refrigerated Products

Some Mina Grocery products require refrigeration or other temperature-controlled storage.

Customers are responsible for promptly retrieving pickup orders and receiving delivered orders during the designated delivery period.

Once an order has been picked up by the customer, delivered to the delivery address, or otherwise transferred into the customer's possession, the customer is responsible for appropriate storage, refrigeration, handling, and food safety.

Perishable products should not be left unattended or unrefrigerated for extended periods.

6. Pickup Orders

Orders designated for store pickup must be collected from Mina Grocery during the pickup window or according to the instructions provided with the order.

Please wait until you receive confirmation that your order is ready before arriving for pickup.

Because some orders contain perishable products, customers should make reasonable efforts to collect orders at the scheduled time.

If circumstances prevent you from picking up your order, please contact Mina Grocery as soon as possible.

7. Local Delivery & Third-Party Delivery Services

Mina Grocery may offer delivery directly or through third-party delivery providers such as DoorDash, Instacart, or other delivery services.

Delivery times are estimates and may be affected by traffic, weather, driver availability, order volume, or circumstances outside Mina Grocery's control.

When a third-party delivery provider is used, portions of the delivery experience may also be governed by that provider's terms and policies.

Customers are responsible for providing an accurate delivery address, contact information, access instructions, gate codes, apartment numbers, and any other information reasonably necessary to complete delivery.

Mina Grocery is not responsible for delays or unsuccessful deliveries resulting from incorrect or incomplete information supplied by the customer or the customer's unavailability to receive an order requiring delivery.

8. Unattended Deliveries

If an order is eligible to be left unattended, the customer accepts responsibility for the products once delivery has been completed at the address provided.

This is particularly important for refrigerated, frozen, or otherwise perishable products. Mina Grocery cannot guarantee the condition or safety of perishable products that remain outside or unattended after delivery.

9. Returns, Refunds & Perishable Goods

Because of the nature of food and perishable products, grocery and food purchases are generally final sale and cannot be returned or exchanged simply because of personal preference.

However, we want you to receive what you ordered in appropriate condition.

If an item is missing, incorrect, damaged, spoiled upon receipt, or otherwise materially different from what you ordered, please contact Mina Grocery promptly after receiving your order. Photographs may be requested so that we can evaluate the issue.

When appropriate, Mina Grocery may provide a replacement, store credit, or refund at our discretion and as required by applicable law.

We cannot provide refunds for products that have deteriorated because they were not picked up promptly, were left unattended following delivery, or were improperly stored after pickup or delivery.

10. Order Cancellations

Because we may begin preparing, cutting, packaging, or assembling grocery orders shortly after they are placed, orders may not always be eligible for cancellation.

If you need to change or cancel an order, contact Mina Grocery as soon as possible. We will make reasonable efforts to accommodate the request but cannot guarantee that an order can be changed or canceled once preparation has begun.

11. Substitutions

Certain grocery products may sell out unexpectedly.

We will make reasonable efforts to follow any substitution preferences offered during checkout. When appropriate, we may contact you before making a significant substitution.

If a suitable substitution cannot be made, the unavailable item may be removed from your order and refunded.

12. Pricing & Errors

Prices are subject to change without notice.

Although we make reasonable efforts to ensure accurate pricing and product information, errors may occasionally occur. We reserve the right to correct typographical, pricing, inventory, or product-information errors and to cancel or modify orders affected by an obvious error.

If we cancel an item for which you have already been charged, the applicable amount will be refunded.

13. Promotions & Discount Codes

Promotions and discount codes may be subject to additional restrictions, expiration dates, minimum purchases, product exclusions, or other conditions.

Unless expressly stated otherwise, promotional offers cannot be combined.

We reserve the right to modify or discontinue promotions and to cancel orders involving misuse, unauthorized reproduction, fraud, or abuse of a promotional offer.

14. Age-Restricted Products

Certain products may be subject to age restrictions under applicable law.

Where required, customers must meet the applicable minimum age requirement and may be required to present valid government-issued identification at pickup or delivery.

We reserve the right to refuse or cancel the sale of an age-restricted product when legally required or when appropriate identification cannot be verified.

15. Online Payments

By submitting payment information, you represent that you are authorized to use the payment method provided.

We reserve the right to refuse, cancel, or review orders that appear fraudulent, unauthorized, unusually high-risk, or otherwise inconsistent with normal purchasing activity.

16. Website Use

You may not use the Mina Grocery website for unlawful, fraudulent, abusive, or unauthorized purposes.

You may not interfere with the operation or security of the website, attempt to gain unauthorized access to our systems, use automated systems to improperly access or scrape the website, or submit false or misleading information.

17. Intellectual Property

Unless otherwise indicated, Mina Grocery's original website content, branding, photographs, graphics, written materials, and other original creative content are owned by or licensed to Mina Grocery and may not be reproduced or commercially used without permission.

Product names, manufacturer trademarks, and third-party materials remain the property of their respective owners.

18. Third-Party Services

Our website and services may interact with third-party platforms, payment processors, delivery providers, social networks, mapping services, and other technology providers.

Those third parties may maintain their own terms and privacy practices. Mina Grocery is not responsible for the independent operation of third-party platforms or services.

19. Disclaimer & Limitation of Liability

To the fullest extent permitted by applicable law, Mina Grocery is not responsible for indirect, incidental, special, or consequential losses arising from use of our website, products, or services.

Nothing in these Terms is intended to waive or limit rights or remedies that cannot legally be waived or limited under applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mina Grocery and its owners, employees, agents, and service providers from claims or expenses resulting from your unlawful use of our website or services, your violation of these Terms, or your violation of another person's rights.
